Terms of Service

These terms cover your use of SpellChirp. They’re written to be read, not to be survived. By using the app you’re agreeing to them.

1. Who can use SpellChirp

SpellChirp is designed for children to use with a parent or guardian. If you’re setting up an account you must be 18 or older and be the parent or legal guardian of the children you add — or have their guardian’s permission. You’re responsible for what happens under your account, including what your child does with the device you hand them.

2. Your account

An account is optional; the app works without one. If you create one, sign-in is by a six-digit code sent to your email, so keep your inbox secure. Tell us at hello@spellchirp.com if you think someone else has got into it. You can delete your account at any time and we’ll remove the data within 30 days.

3. Your content stays yours

Word lists, sentences you write, tags, photos you attach and your child’s handwriting are yours. You grant us only the permission we need to run the service for you — storing it, syncing it between your devices, and showing it back to you. We don’t publish it, sell it, or use it to train models. If you delete it, it’s gone.

4. What you agree not to do

  • Upload anything unlawful, or anything you don’t have the right to upload.
  • Try to break, overload or reverse-engineer the service, or get at another family’s data.
  • Resell or rebrand SpellChirp as your own product without written permission.
  • Use it in a way that puts a child at risk.

5. Free and paid plans

The Nest plan is free and stays free. Paid plans are billed in advance and renew until you cancel; cancelling stops the next charge and you keep the features until the period ends. We don’t bill for the free tier and we won’t start without telling you first. Prices shown on the site may change, but never for a period you’ve already paid for.

6. Definitions and word data

Definitions, pronunciations and example sentences are fetched automatically from a third-party dictionary and are offered as a helpful starting point. They can be wrong, oddly worded, or not right for a young reader — that’s why every field is editable. Check anything that matters before a spelling test.

7. Availability

We try hard to keep SpellChirp running, but we don’t promise uninterrupted service. Features may change or be retired. If we ever shut the service down, we’ll give account holders reasonable notice and a way to export their data.

8. Liability

SpellChirp is provided “as is”. To the extent the law allows, we’re not liable for indirect or consequential loss, and our total liability to you is limited to what you paid us in the twelve months before the claim (which, on the free plan, is nothing). Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can’t be limited by law. If you’re a consumer, your statutory rights are untouched.

9. Ending things

You can stop using SpellChirp whenever you like. We may suspend or close an account that breaks these terms or puts others at risk — we’ll explain why unless we’re legally prevented from doing so.

10. Changes to these terms

We’ll post updates here with a new date. For material changes we’ll email account holders first. Carrying on using the app after a change means you accept it.

11. Law

These terms are governed by the laws of the jurisdiction in which SpellChirp is established, and disputes go to its courts — without taking away any protection you have under the mandatory law of the country you live in.

This page describes how SpellChirp works today, in plain English. It isn’t legal advice, and if your family’s situation depends on the fine print you should take your own.
